Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Friebly mobile application ("App") or website ("Site") operated by Friebly ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the App.

1. Eligibility

You must be at least 16 years old to use Friebly. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using the App on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

2. Account Registration

To use Friebly, you must register using a valid mobile phone number. We will send a one-time verification code to authenticate your identity. You are responsible for keeping your account secure and for all activity that occurs under your account.

You agree to provide accurate and current information during registration. You may not create an account on behalf of another person or use a phone number you do not own or control.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

3. Description of Service

Friebly is a mobile application that allows registered users to broadcast short-lived "signals" indicating their current availability for social activities (e.g., coffee, a run, dinner). Other users who are on your friends list can see your signals and optionally join, forming an ephemeral group chat that expires automatically.

The Service is intended to facilitate real-world social interactions among people who already know each other. It is not a public social network, dating service, or professional networking platform.

4. Acceptable Use

You agree not to use Friebly to:

  • Harass, threaten, bully, or intimidate other users in any way.
  • Post or share any content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable.
  • Impersonate another person or create a fake identity.
  • Attempt to gain unauthorised access to the App, its servers, or any connected systems.
  • Use the App to send unsolicited commercial messages or spam.
  • Interfere with or disrupt the integrity or performance of the App.
  • Scrape, crawl, or systematically extract data from the App.
  • Use the App for any commercial purpose without our prior written consent.

We reserve the right to remove content or suspend accounts that violate these standards.

5. Location Services

Some features of Friebly, such as dropping a meet-up pin, require access to your device's location. Location data is used solely to enable the features you actively choose to use. We do not continuously track your location in the background without your explicit consent.

You may disable location access at any time through your device settings; however, doing so may limit the functionality of the App.

6. Friend Connections

Friebly uses your device's contact list solely to help you find people you know who are already registered on the platform. We do not store your full contact list on our servers beyond what is necessary for this one-time matching process.

Friend connections are mutual — both users must agree before either can see the other's signals.

7. Ephemeral Content

Signals and group chats on Friebly are intentionally short-lived. Signals expire automatically at the end of their stated time window. Group chat messages are deleted from our servers once the associated signal closes.

While we take reasonable measures to enforce this ephemerality, you acknowledge that other participants may screenshot or otherwise record content before it expires. We are not responsible for content that is retained or shared by other users outside the App.

8. Intellectual Property

All rights, title, and interest in and to the Friebly App, including its design, code, trademarks, and content created by us, are owned by or licensed to Friebly. Nothing in these Terms grants you any right to use our intellectual property except as strictly necessary to use the App.

You retain ownership of any content you post through the App. By posting content, you grant us a limited, non-exclusive, royalty-free licence to use, store, and display that content solely to operate and improve the Service.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Friebly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising from or related to these Terms or the App shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) €50.

11. Indemnification

You agree to indemnify, defend, and hold harmless Friebly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or your violation of these Terms.

12. Termination

You may stop using the App at any time by deleting your account from within the App settings. Upon account deletion, your profile, signals, and messages will be removed from our servers in accordance with our Privacy Policy.

We may suspend or permanently terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Sweden.

If you are a consumer located in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page and notify you through the App or by other appropriate means. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the new Terms.

If a change materially affects your rights, we will give you at least 30 days' notice before the change takes effect.
